6 Scenarios to Expect if Trump Gets Elected (and Imprisoned)

An impeachment

Probably the least likely scenario is that Congress rises to the challenge of what to do with an individual who got elected as president and is also a current inmate.

The House might adopt articles of impeachment holding that the crimes for which Trump was convicted in state or federal court also qualify as high crimes and misdemeanors.

The Senate could even try him on those articles of impeachment, and the outcome might represent Trump’s removal from office. As Republicans currently control the House, it seems quite unlikely they would take such a step.

Even if they did so, conviction in the Senate would hardly be assured. There are plenty of constitutional challenges to this path, which would definitely increase the difficulty of persuading the needed number of legislators to follow along.

First things first, the federal charges that could arise from Trump’s actions in Mar-a-Lago also involve his conduct while out of office. Whether a federal office can even be impeached for out-of-office misbehavior is, for now, an unsettled matter from a constitutional point of view.

A post-inauguration disability

The 25th Amendment is being recognized more and more every day. Adopted in the wake of President John F. Kennedy’s assassination, the amendment provides the needed possibility of a still-living president being unable to perform the duties of his office.

Section 4 of the amendment has been very much discussed lately since it allows the Cabinet to involuntarily strip the president of his powers.

    1. I hope you believe the Biden Crime Family should go to prison too? Biden doesn’t believe he can win fairly, so he uses democrat judges and prosecutors to help him win the election. That is really sad.

    2. Trump violated no law. Presidents are immune to all classified doc laws, and can give permanent copies of any classified docs to anyone, including himself. The NY law Bragg used is to prevent scammers from adding false profit entries to books, and hush money NDA purchases are “legal expenses” for a celebrity. Jan 6 was protected political expression. There can be no such thing as a fraudulent elector since the parties pick them before the election, and they act in public sessions of the state legislature.

  2. What is most illegal is trying to prevent an election with bogus charges against a candidate. I have NEVER seen anything as illegal as that in the whole history of the country.
